Terms and Conditions

These terms govern your purchase and use of a JoltMoto Trail or Trail XL electric dirt bike, and your use of joltmoto.com. By placing an order or using this site, you confirm you have read and accepted these terms.

We’ve tried to write these in plain English. If anything is unclear, text or email us before you order — we’re real people and we’d rather answer a question than have you guess.

1. Off-Road Use Only

The JoltMoto Trail and Trail XL are off-road electric vehicles. They are not street-legal as deliveredin any U.S. state we’re aware of. They are not classified as bicycles, e-bikes, mopeds, or low-speed vehicles under federal or state vehicle codes.

Lawful use of the bike is generally limited to private property with the owner’s permission, designated off-highway vehicle (OHV) areas, and other locations where off-road motor vehicles are permitted. California requires an OHV permit for public off-road areas. Other states have their own rules. You are responsible for knowing and following your local laws.

If you intend to ride on public roads, you would need to register the bike as a motorcycle with your state DMV, which may require modifications, a title and VIN, insurance, and a motorcycle endorsement on your driver’s license. We make no representation that the bike can be registered for street use in your state.

2. Who Can Buy

You must be:

  • At least 18 years old;
  • Purchasing for yourself or as a gift for an adult (the bike is not designed for or intended for children);
  • Shipping to a U.S. address. We do not ship internationally at this time.

3. Product Specifications

Specifications listed on this site — motor power, battery capacity, top speed, range, dimensions, weights — are based on supplier data and our own measurements. Real-world performance varies with rider weight, terrain, temperature, tire pressure, and other conditions.

Physical dimensions shown in our diagrams are hand-measured and may vary slightly from the bike you receive. Photographs are representative; color and finish may differ slightly.

4. How Orders Work

We do not run an automated checkout. Every order follows this process:

  • You contact us (text or email) to confirm we have your variant — Trail or Trail XL — in stock.
  • We confirm stock and pricing in writing.
  • You send payment via Cash App to the handle listed on our How to Order section, including your full name, delivery address, and variant choice in the note field.
  • Once payment is received and we’ve verified the order details, the order is final and we begin processing.

An order is not confirmed until both stock confirmation and payment are received. Quoted prices and stock availability are not guaranteed until we confirm in writing.

5. Payment

We accept two payment methods: Cash App (peer-to-peer) and bank wire / ACH. Cash App is a peer-to-peer payment service operated by Block, Inc., a publicly traded U.S. company. By sending payment to our Cash App handle, you acknowledge that:

  • Cash App peer-to-peer transfers are not protected by credit-card chargeback rights. We require you to confirm stock and ask every question before sending payment;
  • You are sending the payment voluntarily to a specific recipient (us) for a specific product (your chosen JoltMoto variant);
  • Cash App’s terms of service govern your use of the Cash App platform; this contract governs your purchase of the bike.

Bank wire / ACH is offered as an alternative payment method for buyers who prefer to send funds directly from their bank. Wire instructions (recipient name, bank, routing number, account number) are sent to you privately by text or email after we’ve confirmed stock and your order details — we do not publish those details on the site. Once a wire clears it is final and not reversible; the same confirm-first policy applies.

Prices are in U.S. dollars and do not include any state sales tax. Tax obligations on your end (use tax, registration tax, OHV permit fees) are your responsibility.

6. Shipping and Delivery

We ship from our California warehouse via freight carrier to the U.S. delivery address you provide. Typical timing:

  • In-stock orders: bike leaves the warehouse within 1–2 business days, with tracking sent via text or email.
  • Out-of-stock orders: next batch typically lands within 3 weeks. We confirm before collecting payment.

Freight delivery requires a signature. Schedule with the carrier when they call you to arrange. You are responsible for ensuring someone 18+ is present to receive the shipment and inspect the crate. Re-delivery fees from missed deliveries are your responsibility.

7. Freight Damage

Inspect the crate before you sign. Freight damage is rare but possible. If you see damage to the crate or visible damage to the bike before signing:

  • Note the damage on the delivery receipt (bill of lading) before signing — this preserves your claim;
  • Take clear photographs of the crate, damage, and packaging;
  • If the damage is significant, you may refuse the shipment — refusal must be marked on the delivery receipt;
  • Contact us within 24 hours of delivery with photos and a description.

We will work with the freight carrier and our supplier (with whom we hold a trade-assurance arrangement) to make it right. Failure to note damage on the bill of lading or to contact us within 24 hours significantly limits the claim we can make on your behalf.

8. Returns, Refunds, and Cancellations

All sales are final. Because these are large freight items, we cannot accept returns after delivery is accepted. This is also why we require you to confirm stock, ask every question, and review the FAQ before sending payment.

Before payment is sent: no obligation. You can walk away at any time.

After payment is sent but before the bike ships: contact us immediately. If we have not yet shipped, we’ll refund you via Cash App less any non-refundable processing fees.

After the bike ships: no cancellation. Damaged-on-arrival claims are handled under Section 7, not as a return.

9. Warranty

We provide a 1-year limited warranty from the date of delivery, covering manufacturing defects on:

  • Motor
  • Battery pack
  • Motor controller

The warranty does not cover:

  • Wear-and-tear items including (without limitation): tires, brake pads, chain, sprockets, bearings, cables, handlebars, levers, grips, plastics, fasteners, fluids;
  • Damage from crashes, drops, or impact;
  • Damage from water exposure beyond the bike’s IPX6 rating (the bike is rated for splashing water from any direction; it is NOT rated for submersion);
  • Damage from misuse, racing, stunts, jumping, or use beyond the bike’s stated capacity (rider plus cargo up to 275 lb);
  • Damage caused by modifications, aftermarket parts, or repairs performed by anyone other than a qualified technician;
  • Cosmetic wear, fading, or scratches from normal use;
  • Loss or damage from theft, fire, or any cause other than a manufacturing defect.

Warranty claims require photos and a description of the issue. Where the supplier requires the defective part returned for inspection, you are responsible for cooperating with that process. We may, at our discretion, repair, replace, or refund the affected component.

10. Modifications Void the Warranty

Modifying the bike — including changing the controller programming, replacing the battery with a non-stock pack, removing speed limiters (if any), swapping the motor, or altering the frame — voids the warranty in full. We are also not liable for any damage, injury, or legal consequence resulting from modifications.

11. Assumption of Risk

Riding any motor vehicle, especially an off-road dirt bike capable of 47 mph, carries an inherent risk of serious injury or death. By purchasing and riding a JoltMoto, you acknowledge that:

  • You assume all risk associated with riding the bike;
  • You will always wear a DOT-approved or Snell-rated helmet;
  • You will wear appropriate protective gear (eye protection, gloves, sturdy footwear, body armor as appropriate);
  • You will not ride under the influence of alcohol, drugs, or any substance that impairs your reaction or judgment;
  • You will not allow anyone under 18 to operate the bike;
  • You will not exceed the bike’s rated capacity (275 lb rider plus cargo);
  • You will not operate the bike in conditions for which it is not rated (deep water, public roads where prohibited, etc.).

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Our total liability to you, in contract, tort, or otherwise, for any claim arising from or related to your purchase and use of a JoltMoto, is limited to the amount you actually paid for the bike;
  • In no event are we liable for any indirect, incidental, special, consequential, or punitive damages — including lost income, medical expenses, or property damage — arising from your use of the bike;
  • Some jurisdictions do not allow the exclusion of incidental or consequential damages, so the above may not fully apply to you. Nothing in these terms limits any liability that cannot be limited under applicable consumer protection law.

13. Indemnification

You agree to indemnify and hold harmless JoltMoto, its operators, and its suppliers from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your use of the bike, your violation of these terms, or your violation of any law or third-party right.

14. Communications

By providing your phone number and email at order time, you consent to receive messages from us about your order — stock confirmation, payment receipt, shipping tracking, delivery scheduling, warranty follow-up. We will not use your contact information for marketing or share it with any party other than the freight carrier and our supplier for fulfillment.

15. Intellectual Property

The JoltMoto wordmark, the joltmoto.com site design, all written copy, photography, video, and the “Industrial Voltage” visual treatment are our property. You may not reproduce or republish any of this content without our written permission. The bike itself, once purchased, is yours to ride, photograph, and post about as you like (and we’d love to see it).

16. Governing Law and Disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising under these terms or your purchase shall first be addressed in good faith between you and us by email or text.

If the dispute cannot be resolved that way:

  • Claims within the California small-claims court jurisdictional limit may be brought there;
  • Other claims shall be brought in the state or federal courts located in California, and you consent to personal jurisdiction in those courts;
  • Each party waives any right to a jury trial and to participate in any class action.

17. Changes to These Terms

We may update these terms from time to time. The “Last updated” date at the top reflects the most recent revision. The terms in effect when you place your order govern that purchase. Continued use of the site after a change to these terms means you accept the updated terms for future activity.
